Security Guard Imprisoned for 10 Years, Five Lashes for Rape of Disabled Woman
JOHOR BAHRU, March 27 (Bernama) — A security guard was sentenced to 10 years in prison and five lashes by the Sessions Court here today after pleading guilty to raping a woman with disabilities (OKU).
Judge Madihah Zainol sentenced the defendant, 39 years old, and ordered the defendant to undergo counseling during his detention in addition to being under police supervision after completing his sentence.
The man is accused of raping a 29-year-old woman who he knew had physical disabilities related to hearing, speech and learning delays in Skudai, in the Iskandar Puteri area at 23.50, 30 January.
The charges were brought in accordance with Article 376(2)(K) of the Criminal Code which stipulates a prison sentence of not less than 10 years and not more than 30 years and caning.
Deputy Public Prosecutor Nor Fadilah Johanuddin asked the court to give an adequate sentence on the grounds that the defendant took advantage of the disabled victim.
“Apart from that, the defense informed the defendant that he had HIV. This action put the victim at risk of contracting a sexually transmitted disease,” he said.
Lawyer Omar Kutty Abdul Aziz, who represented the man, appealed for a lighter sentence because his client has HIV and leukemia which requires ongoing treatment, and this was his first offence.
