A man was acquitted of raping a 14-year-old teenager
KUALA LUMPUR, May 12 (Bernama) — A man was acquitted and acquitted by the Sessions Court here today of allegedly raping a 14-year-old girl five years ago.
Judge Tasnim Abu Bakar made the decision after finding that the prosecution failed to prove a prima facie case against the 34-year-old man at the end of the prosecution’s case.
When reading the verdict, Tasnim said that the court considered that the statement of the victim, who was the third witness for the Public Prosecutor (SP3) in the case, could not be categorized as reliable information.
“While the main witness, namely SP3, gave a statement during cross-examination, the court allowed the defense’s request to initiate proceedings to challenge the witness’ credibility.
“The process of challenging credibility was initiated after the defense discovered material discrepancies with the trial of the defendant at the Klang Sessions Court on the same charges,” said the judge.
Tasnim said that the court listened, examined and took maximum consideration to the statements of prosecution witnesses as well as oral arguments submitted by both parties including the Child Evidence (Amendment) Act 2024.
“This court is of the opinion that the explanatory evidence during the trial challenges credibility, and the trial of this case cannot be categorized as credible, so that prosecutors have failed to establish a prima facie case for the amended indictment in this case.
Therefore, the defendant was acquitted and acquitted of this amended charge, he said.
A total of 11 prosecution witnesses including the victim and the victim’s mother, pediatric medical officers and obstetrics and gynecology (O&G) specialists were called to testify throughout the prosecution case.
The victim is the same teenager in the case at the Klang Sessions Court who was charged with six counts of rape, sexual assault and having sex with an object.
Based on the amended indictment, the man, a father of eight children, was charged with raping a then 14 year old teenage girl in a hotel room on Jalan Imbi, Bukit Bintang, between 02.00 and 10.00, 3 Dec 2021.
The charges against him were filed in accordance with Article 375(g) of the Criminal Code and are punishable under Article 376(1) of the Criminal Code which carries a maximum prison sentence of 20 years and can be caned if found guilty.
The prosecution was handled by Deputy Public Prosecutor Siti Pervinah Mohamad Yusof, while the speaker was represented by lawyer Muhammad Ashraff Mohd Diah.
When met after the trial, Siti Pervinah said that the prosecutor would appeal the decision in this case.
On 18 September 2025, the defendant was sentenced to 15 years in prison and three strokes of the cane by Sessions Court Judge Noridah Adam (then Klang Sessions Court Judge) after being found guilty of rape and committing physical sexual violence against the same victim in July 2021.
Noridah did not allow the prison sentence to be suspended, but the defendant was later released after the High Court allowed the sentence to be suspended pending appeal.
